Answer: Work on a contingency. For two reasons. Purchase judgment method is not for beginners. First of all, the purchase method is for recovery specialists who have been in the industry long enough to develop an eye for promising cases. After you get some experience as a judgment recovery professional, you will have the skills needed to pre-screen cases and evaluate their potential for success. Skip-tracing and previous cases will help you identify cases that are worth an investment.
Secondly, the purchase method requires a considerable up-front investment on the part of the judgment recovery specialist. You will be purchasing the entire judgment outright, so you must have the initial funds to do so. Offering to purchase the judgment is effective if you are dealing with an older case. The holder will be ready to finally be rid of the hassle, and will likely sell for a fraction of the total value.
2. Question: Do you ever contact the debtor and give them a chance to settle?
Answer: The judgment holder will receive and sign a form called an Acknowledgement of Assignment form. The judgment holders signature allows you to collect on his or her behalf.
Once this form is filed with their case at the courthouse, you can begin to search for the debtor and his or her assets. Once found, you will begin the procedure to levy those assets. After the assets have been seized, and you have collected the funds, you will write them a check for their substantial percentage of the recovered judgment. After pulling a credit report, you should have all the information needed
to locate not only the debtor, but also any assets. If that doesn't’t work, you have several other skip-tracing techniques that have worked well in the industry. Naturally, direct contact with the debtor is also an option.
You will have greater success if you treat the debtor with respect. If you decide to contact the debtor:
1. Do not call the debtor late at night or early in the morning.
2. Do not send correspondence in an envelope that might cause embarrassment.
3. Comply with the debtor’s requests if he or she tells you to cease contact.
4. Comply with the debtor’s request if he or she tells you not to visit at home or work.
5. Do not threaten the debtor with publication of his or her name or public disclosure of the debt.
6. Do not imply to the debtor that he or she is a criminal.
7. Do not attempt to intimidate the debtor with strong language.
8. Do not threaten the debtor or his family and friends with bodily harm.
9. Do represent yourself as a paralegal or attorney.
10. Do not ask the debtor’s employer to influence the debtor or encourage satisfaction of the judgment
